Terms
of Service
1. You understand and agree that the National
Association of Physical Activity and Health (NAPAH) is a not-for-profit
corporation and that its website services (under NAPAH.ca) are
provided to users ("you" or "User" or, collectively, "Users")
exclusively under this NAPAH Terms of Service. By completing
the registration process and clicking the "Activate Account"
button, you are eligible to open a NAPAH membership account,
and you agree to have read and understood the Terms of Service,
and agree to be bound by the Terms of Service in effect and
as updated by NAPAH from time to time.
2. NAPAH reserves the right to terminate any User's account
if NAPAH learns that such User has provided NAPAH with false
or misleading membership registration information or has violated
the Terms of Service Agreement . NAPAH will not provide any
notification of cancellation of any members User account .
3. A complete statement of NAPAH privacy
policy can be found in its entirety in its special section.
4. NAPAH may modify or discontinue any of its services or any
User's account with or without notice to any User, without liability
to any User or any third party.
5. You understand and agree that NAPAH services are provided
"AS IS " with no warranties.
6. You are responsible for maintaining the confidentiality of
your account number and/or password. You are responsible for
all uses of your account, whether or not authorized by you.
You agree to immediately notify NAPAH of any unauthorized use
of your account.
7. YOU UNDERSTAND AND EXPRESSLY AGREE THAT USE OF NAPAH SERVICES
ARE AT YOUR SOLE RISK, THAT ANY MATERIAL AND/OR DATA DOWNLOADED
OR OTHERWISE OBTAINED THROUGH THE USE OF NAPAH SERVICES IS AT
YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE
FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT
RESULTS FROM THE DOWNLOAD OF SUCH MATERIAL AND/OR DATA.
NAPAH EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS
OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
8. NAPAH MAKES NO WARRANTY OR REPRESENTATION REGARDING THE ACCURACY
OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH NAPAH SERVICES,
BE UNINTERRUPTED, TIMELY, SECURE OR ERROR FREE.
9. NAPAH WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL,
SPECIAL OR CONSEQUENTIAL PERSONAL DAMAGES OF ANY KIND RESULTING
FROM OPINIONS, ADVICE OR RECOMMENDATIONS MADE FROM ANY CONTRACTOR
OR EMPLOYEE AT NAPAH INCLUDING ANY ADVISORS IN ANY OF OUR FEATURES.
10. NAPAH WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL,
SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND RESULTING FROM
THE USE OF OR THE INABILITY TO USE NAPAH SERVICES, RESULTING
FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR MESSAGES
RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH NAPAH SERVICES,
RESULTING FROM LOSS OF, UNAUTHORIZED ACCESS TO OR ALTERATION
OF USER'S TRANSMISSIONS OR DATA OR FOR THE COST OF PROCUREMENT
OF SUBSTITUTE GOODS AND SERVICES, INCLUDING BUT NOT LIMITED
TO DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLES.
11. You agree to indemnify, defend and hold harmless NAPAH its
affiliates, officers, directors, employees, consultants and
agents from any and all third party claims, liability, damages
and/or costs (including, but not limited to, attorneys fees)
arising from your use of NAPAH services, your violation of the
Terms of Service or your infringement, or infringement by any
other user of your account, of any intellectual property or
other right of any person or entity.
12. The Terms of Service will be governed by and construed in
accordance with the laws of the Province of Ontario, Canada,
without giving effect to its conflict of laws provisions or
your actual province, state or country of residence.
13. The Terms of Service will inure to the benefit of NAPAH
successors, assigns and licensees.
14. Any waiver of any provision of the Terms of Service will
be effective only if in writing and signed by authorized directors
of NAPAH.
15. If for any reason a court of competent jurisdiction finds
any provision or portion of the Terms of Service to be unenforceable,
the remainder of the Terms of Service will continue in full
force and effect.
16. The Terms of Service constitute the entire agreement between
the parties with respect to the subject matter hereof and supersedes
and replaces all prior or contemporaneous understandings or
agreements, written or oral, regarding such subject matter.

a " AS IS " basis and protected by this legal disclaimer
. NAPAH is not responsible for the accuracy of all news, health
content, or any other information displayed on the website .
All users of NAPAH are encouraged to confirm the accuracy with
other reliable sources . NAPAH is not responsible or liable
in any circumstances for any lost profits or other consequential
damages that may result from any errors displayed on NAPAH.
All the health content may be used by members only for educational
purposes and NAPAH will not be liable for any health decisions
made by anybody based on information displayed on the website
or relying on the printable version of the health articles.
NAPAH health content is not meant to guide users in respect

or Prevention Literature databases Medline, NPIN, ODPHP, NHIC,
USPSTF, Merck, CDC are public information databases and the
copyrights are exclusively with each organization.
Health News : News service may be provided by various sources
such as Reuters, HealthScoutNews, AP, CNN, or PR Newswire and
content of the material is and remains the copyrighted property
of the referenced source noted at the bottom of each individual
article.

pages without requesting permission. However, NAPAH's regulations,
